Welcome to the website of Gele Properties LLC ("Gelé Properties," "we," "us," or "our"), located at www.geleproperties.com (the "Site"). By accessing or using the Site, submitting an inquiry, or booking with us, you agree to these Terms & Conditions ("Terms"). If you do not agree, please do not use the Site.
These Terms are intended to be general website terms. Internal SMS messaging is governed by our SMS Policy at https://www.geleproperties.com/pages/sms-policy . Bookings and tenancies are additionally governed by the applicable reservation agreement, rental agreement, or lease, which control over these Terms in the event of a conflict.
1. Use of Website
You may use the Site only for lawful purposes. You agree not to:
- Use the Site in any way that violates applicable law or regulation
- Attempt to gain unauthorized access to the Site, its servers, or connected systems
- Interfere with the operation of the Site or the use of the Site by others
- Use automated tools to scrape, harvest, or extract data from the Site
- Submit false, misleading, or fraudulent information in any inquiry, application, or booking
2. Bookings, Applications, and Payments
Inquiries and booking requests submitted through the Site are not confirmed reservations until we accept them and any required payment is completed. All bookings are subject to the terms of the applicable reservation or rental agreement, including cancellation, refund, deposit, and house-rule provisions. Rates, availability, and property details displayed on the Site are subject to change without notice. We reserve the right to decline or cancel any booking request in accordance with applicable law.
3. Intellectual Property
All content on the Site, including text, photographs, listing descriptions, branding, and logos, is the property of Gelé Properties or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written permission, except for your own personal, non-commercial use in connection with evaluating or booking a stay.
4. Communication Consent
By providing your contact information, you agree that we may contact you by email, phone, platform message (such as messaging through a booking platform), or mail regarding inquiries, applications, bookings, leases, property access, maintenance, payments, support, legal notices, or other business-related matters. We will not send you SMS text messages unless you have separately enrolled in an SMS program governed by our SMS Policy.
5. SMS Messaging
Gele Properties LLC operates an SMS notification program that is limited to internal communications with our employees, contractors, and authorized staff. The full terms of that program, including enrollment, opt-out, message frequency, and cost disclosures, are set out in our SMS Policy at https://www.geleproperties.com/pages/sms-policy.
We do not operate a customer-facing SMS text messaging program, and consent to receive SMS messages is not required as a condition of booking, renting, or purchasing services from us.
We do not share SMS opt-in data or mobile phone numbers with third parties or affiliates for marketing or promotional purposes. Supported carriers are not liable for delayed or undelivered messages.
6. Disclaimers
The Site and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components. Property descriptions and photographs are provided for general information; while we strive for accuracy, minor variations may exist.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Gelé Properties, its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Site. To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to the Site or these Terms will not exceed the greater of (a) the amounts you paid to Gelé Properties in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred dollars ($100). Nothing in these Terms limits liability that cannot be limited under applicable law. Liability arising under a reservation agreement, rental agreement, or lease is governed by that agreement.
8. Indemnification
You agree to indemnify and hold harmless Gelé Properties, its members, managers, employees, and agents from and against claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or misuse of the Site.
9. Governing Law and Venue
These Terms are governed by the laws of the State of Alabama, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Mobile County, Alabama, and you consent to the personal jurisdiction and venue of those courts.
10. Severability
If any provision of these Terms is held invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if it cannot be modified, and the remaining provisions will continue in full force and effect.
11. Third-Party Sites and Platforms
The Site may link to third-party websites and booking platforms. We do not control and are not responsible for their content, policies, or practices. Bookings made through third-party platforms are also subject to that platform's terms of service.
12. Changes to These Terms
We may revise these Terms from time to time. The "Last Updated" date at the top reflects the most recent revision. Changes take effect when posted on this page, and your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
